. (a) Any association that does not commence business within
one year after the date of the issuance of its certificate of
approval of articles of incorporation shall forfeit its certificate
of approval of articles of incorporation, unless the commissioner,
before the expiration of the one year period, shall have approved the
extension of time within which it may commence business, upon a
written application stating the reasons for delay. Upon forfeiture,
the association's certificate of approval of articles of
incorporation shall expire. Amounts credited on savings accounts or
paid in on capital stock, including any income earned on these funds,
shall be returned on a pro rata basis to their respective
subscribers.
(b) The commissioner shall immediately notify the Secretary of
State of forfeiture under this section.
