Every person that violates this division is guilty of a
misdemeanor and upon conviction shall be punished by a fine of not
less than one hundred dollars ($100) nor more than one thousand
dollars ($1,000), or by imprisonment of not less than 10 days nor
more than one year, or by both that fine and imprisonment. Each
violation during any day constitutes a separate offense.
Any person who uses an unrecorded, forfeited, or canceled
brand shall pay a penalty upon a first violation of one hundred
dollars ($100); upon a second violation within the same 12-month
period, a penalty of two hundred dollars ($200); and upon a third or
subsequent violation within the same 12-month period, a penalty of
five hundred dollars ($500), which is in addition to any other
penalty provided by law.
