This chapter provides certain standards of quality,
condition, or fill of container and requirements for marking of
fruits and vegetables, including olives, which are packed in tin or
glass containers.
Any act that is made unlawful by Part 5 (commencing with
Section 109875) of Division 104 of the Health and Safety Code is not
made lawful by reason of this part. This part does not limit the
powers of the State Department of Health Services.
Any person or any common carrier may refuse to accept for
shipment or transportation, and may refuse to ship or to transport,
any canned fruit, including olives, which upon inspection are found
to be, or to be packed, in violation of this chapter. Any such person
or common carrier may reserve the right in any receipt, bill of
lading, or other writing which is given to the consignor, to reject
for shipment or transportation and to return to such consignor, or to
hold at the expense and risk of the consignor, all canned fruit,
including olives, which upon inspection are found to be, or to be
packed, in violation of this chapter.
