Whenever any state officer or employee accepts payment from
a revolving fund of a state agency pursuant to Section 16401, the
person authorized to make payments from such revolving fund may
indorse any warrant of the Controller drawn in payment of a claim
submitted by such state agency or revolving fund check drawn by such
state agency made payable to such state officer or employee, on
behalf of and in such payee's name for deposit in and reimbursement
of such revolving fund and payment of any balance to such payee. The
indorsement shall indicate that it is for the purpose of reimbursing
a revolving fund pursuant to this section.
Whenever any warrant is drawn in favor of a payee having a
claim against the State and is delivered to a State agency for
delivery to a payee, and prior to delivery to the payee any facts or
circumstances exist which would affect the validity or alter the
amount of the claim, the person authorized to make payments out of
any funds under the direct control of the State agency may indorse
and deposit the warrant in the treasury to the credit of the fund or
appropriation upon which it was drawn or deposit it to the credit of
the appropriate account under his control. Where such a warrant is
deposited to the account under the control of the State agency, it
shall, when necessary, pay the portion of the claim then due and
payable and return the balance to the treasury to the credit of the
fund or appropriation upon which the warrant was drawn.
A state agency shall notify the Treasurer not to pay a
warrant drawn by the Controller upon that agency's request whenever
that agency has reason to believe that the Controller has drawn or is
about to draw his or her warrant without legal authority, for a
larger amount than is owed by the state, or in a manner not in
conformity with the regulations adopted by the California Victim
Compensation and Government Claims Board for the presentation and
audit of claims. Upon notification from a state agency as described
in this section, the Treasurer shall refuse payment of the subject
warrant until he or she is otherwise directed by the agency or the
Legislature.
The indorsements authorized by this article may be accepted
by the Treasurer and he may pay such warrants.
