The board shall create and adjust classes of positions in
the State civil service. The classes adopted by the board, shall be
known as the Personnel Classification Plan of the State of
California. The classification plan shall include a descriptive title
and a definition outlining the scope of the duties and
responsibilities for each class of positions.
The Department of Human Resources shall designate
managerial positions, as defined in subdivision (e) of Section 3513,
and shall report those designations to the board annually. Any
disputes as to the managerial classification or position designations
may be appealed to the State Personnel Board.
From time to time as it deems necessary, the board may
establish additional classes and divide, combine, alter, or abolish
existing classes. In establishing, altering, or abolishing classes,
the board shall consider the recommendations of the Department of
Human Resources. When those actions are taken the board shall
determine in each instance whether positions affected are to be
reallocated to another class or classes after taking into account the
duties and responsibilities, qualifications, performance standards,
and other related criteria before and after the change, and shall
determine the status of the probationary and permanent employees
affected.
Upon the reallocation of a position, other than by action of
the board under Section 18802, the incumbent of the position shall
not thereby gain status in the new class. Change in status of the
incumbent may be accomplished only in accordance with the appropriate
sections of this part and rules relating to transfer, demotion, or
promotion.
The classification title or a code symbol approved by the
board shall be used in all communications relating to personnel and
in all budget and financial records.
