The legislative body of a local agency may convey land which
it owns within its boundaries to the United States to be used for
federal purposes and may acquire land for this purpose pursuant to
this article.
Whenever the legislative body determines that it is
desirable for the general welfare and benefit of the people, and for
the interests of the local agency, it may incur an indebtedness
evidenced by negotiable bonds for the purpose of acquiring land to be
conveyed to the United States for federal purposes in consideration
of the benefits to be derived by the local agency from the use of the
lands by the United States for such purposes. The bonds may be
issued in an amount not exceeding, together with all existing bonded
indebtedness of the local agency, 5 percent of its taxable property
as shown by the last equalized assessment of the local agency.
By a four-fifths vote, the legislative body of a local
agency may convey land which it owns within the state to the United
States for use by the Defense Department or as customs and
immigration offices and may expend money from the general fund to
acquire such land or to improve the land it owns or has acquired and
desires to convey to the United States.
Whenever the legislative body determines that it is
desirable for the general welfare and benefit of the people, and for
the interest of the local agency, it may incur an indebtedness
evidenced by negotiable bonds to acquire or improve lands desired to
be conveyed to the United States for use by the Defense Department or
as customs and immigration offices in consideration of the benefits
to be derived by the local agency from the use of the lands by the
United States for such purposes. Such bonds may be issued in an
amount not exceeding the limitations imposed by law upon the general
bonded indebtedness of the local agency.
Except as modified in this article, Chapter 6, Division 3,
Title 3 is applicable to bonds issued by a county pursuant to this
article.
Except as modified in this article, Article 1, Chapter 4,
Division 4, Title 4 is applicable to bonds issued by a city pursuant
to this article.
A local agency may exercise the right of eminent domain to
acquire any property necessary or convenient to carry out this
article.
The consent of the Legislature is given to the United States
to acquire land upon the conditions and for the purposes set forth
in this article.
Title shall be transferred by a deed signed by the chairman
of the legislative body and attested by the clerk under seal.
The legislative body may insert in the deeds any conditions
subsequent necessary to insure the use of the lands by the United
States for the purposes mentioned in, and to carry out the provisions
of, this article.
The Legislature cedes to the United States exclusive
jurisdiction over land conveyed pursuant to this article, reserving
concurrent jurisdiction with the United States for the execution of
all civil and criminal process, issued under authority of the State
as if a conveyance had not been made.
