The governing body of any county or city may, by resolution
or ordinance, create a community energy authority.
(a) The governing bodies of any two or more cities or
counties or any combination thereof may by agreement create an area
energy authority. Each governing body that is a party to such an
agreement shall appoint two persons as commissioners of the
authority, and the governing bodies shall jointly appoint one
commissioner at large, and, upon appointment of all required
commissioners, the area energy authority shall be authorized to
exercise all of the powers which a community energy authority is
authorized to exercise.
(b) Commissioners appointed pursuant to subdivision (a) shall
serve at the pleasure of the governing bodies which appointed them.
(c) A majority of the commissioners of an area energy authority
constitutes a quorum for the purpose of conducting business and
exercising its powers and for all other purposes. Action may be taken
by the area energy authority upon a vote of a majority of the
commissioners.
(d) The commissioners shall select a chairperson from their
number.
The area of operation of an authority created pursuant to
Section 52031 shall be the combined possible areas of operation of
participating cities and counties, as determined by Section 52007.
As an alternative to Section 52032, two or more governing
bodies may jointly exercise any power under this chapter pursuant to
a joint powers agreement entered into pursuant to Chapter 5
(commencing with Section 6500) of Division 7 of Title 1.
