When the legislative body of a local agency finds and by
resolution declares that its location is such that it cannot
adequately or conveniently be provided with conduits, unless it
constructs and maintains certain connecting conduits in, across, or
along certain streets, or other public places of any other local
agency, the legislative body may submit a copy of the resolution to
the legislative body of the other local agency.
The resolution shall contain:
(a) A description of the conduits proposed to be constructed and
maintained in the other local agency.
(b) A description of the streets or other public places in,
across, or along which the conduits are proposed to be constructed
and maintained.
The resolution shall be accompanied by a written request
that permission be granted to the local agency to construct and
maintain the conduits described in the resolution.
The clerk of the local agency shall sign the request.
In its discretion the legislative body receiving the request
and copy of the resolution may grant permission.
The permission shall be granted by ordinance, or by
resolution in the case of a sanitary district.
The ordinance or resolution shall state any terms and
conditions of the permission prescribed by the legislative body.
If the legislative body grants permission for the
construction and maintenance of sewers, it may require as a condition
that it may connect its sewers with those constructed under
permission and use them in connection with its sewer system upon
paying a proportionate part of the cost of constructing and
maintaining them to the local agency constructing them.
The cost may be determined by resolutions of the legislative
bodies of both local agencies. The payment shall be made at the
times and in the amounts determined by the legislative bodies.
