Article 4. Voluntary Declaration Of Paternity of California Health And Safety Code >> Division 102. >> Part 1. >> Chapter 5. >> Article 4.
(a) When a voluntary declaration of paternity is filed with
the State Department of Social Services pursuant to subdivision (d)
of Section 7571 of the Family Code, an application may be submitted
to the State Registrar requesting that the father's name be added to
the child's birth certificate.
(b) Upon receipt of the application and payment of the required
fee, the State Registrar shall review the application for acceptance
for filing, and if accepted, shall establish a new birth certificate
for the child in the manner prescribed in Article 1 (commencing with
Section 102625), if the original record of birth is on file in the
office of the State Registrar.
(a) When a voluntary declaration of paternity is rescinded
pursuant to subdivision (a) of Section 7575 of the Family Code, an
application may be submitted to the State Registrar requesting that
the father's name be removed from the child's birth certificate.
(b) Upon receipt of the application and payment of the required
fee, the State Registrar shall establish a new birth certificate for
the child in the manner prescribed in Article 1 (commencing with
Section 102625), if the original record of birth is on file in the
office of the State Registrar.
All records and information specified in this article,
other than the newly established certificate, shall be available only
to those persons specified in subdivision (h) of Section 7571 of the
Family Code or upon order of a court of record.
The State Registrar shall furnish a certified copy of the
new record of birth prepared under authority of this article to the
registrant without additional cost.
