. (a) It is unlawful for any person to knowingly make a false
statement in connection with any report or record required under this
article.
(b) (1) Any person who violates this section shall be punished by
imprisonment pursuant to subdivision (h) of Section 1170 of the Penal
Code, or by imprisonment in a county jail not exceeding one year, or
by a fine not exceeding five thousand dollars ($5,000), or by both
that fine and imprisonment.
(2) Any person who has been previously convicted of violating this
section and who subsequently violates this section shall be punished
by imprisonment pursuant to subdivision (h) of Section 1170 of the
Penal Code for two, three, or four years, or by a fine not exceeding
one hundred thousand dollars ($100,000), or by both that fine and
imprisonment.
