. The state board may adopt as an emergency regulation, a
regulation, except a regulation that establishes maximum contaminant
levels for primary and secondary drinking water standards, that is
not more stringent than, and is not materially different in substance
and effect than, the requirements of a regulation promulgated
pursuant to the federal Safe Drinking Water Act (42 U.S.C. Sec. 300f
et seq.). The adoption of a regulation pursuant to this section is an
emergency and shall be considered by the Office of Administrative
Law as necessary for the immediate preservation of the public peace,
health, safety, and general welfare. Notwithstanding Chapter 3.5
(commencing with Section 11340) of Part 1 of Division 3 of Title 2 of
the Government Code, an emergency regulation adopted by the state
board pursuant to this section is not subject to review by the Office
of Administrative Law and shall remain in effect until revised by
the state board.
