In order to further the purposes of this part, financial
institutions shall notify all applicants at the time of written
application for financial assistance of the prohibitions enumerated
in Chapter 3 (commencing with Section 35810) and of the right of
review provided by Section 35820. Such notice shall include the
address of the secretary, or the secretary's designee, and where
complaints may be filed and questions may be asked. Such notice shall
be in at least 10-point type and shall also be posted in a
conspicuous place for public inspection.
The provisions of this part, including rules, regulations,
guidelines, and orders issued pursuant to this part, shall not affect
the validity of any prohibitions or requirements pertaining to the
activity of financial institutions that arise from other provisions
of law relating to discrimination in lending. Rules, regulations,
guidelines, and orders issued pursuant to this part shall not be in
any manner contrary to, or inconsistent with, the purposes of this
part.
The provisions of this part shall be liberally construed in
order to effectuate the purposes of this part.
If any clause, sentence, paragraph, or part of this part or
application thereof to any person, financial institution, or
circumstance shall, for any reason, be adjudged by a court of
competent jurisdiction to be invalid, such judgment shall not affect,
impair, or invalidate the remainder of this part and the application
thereof to other persons, financial institutions or circumstances
but shall be confined in its operation to the clause, sentence,
paragraph, or part thereof directly involved in the controversy in
which such judgment shall have been rendered and to the person,
financial institution, or circumstance involved.
