Article 2. Resolution of California Health And Safety Code >> Division 5. >> Part 3. >> Chapter 5. >> Article 2.
Before a district acquires or constructs any works under this
chapter, its governing body shall adopt a resolution declaring its
intention to do so.
The resolution of intention shall contain all of the
following:
(a) A brief and general description of the works. If they are to
be constructed, a reference to the plans and specifications that have
been prepared and filed by the engineer chosen by the governing
body.
(b) The estimated cost of the works to be acquired or constructed,
and the amount of bonds to be issued and sold.
(c) A general description of the area to be served by the proposed
works, referring to a plat of the area, which shall govern for all
details.
(d) An estimate of the number and character of the places and
properties to be served by the works, including those ready for
immediate service and those in expectancy.
(e) An estimate of the immediate revenue that would be received
from the operation of the works, and of future revenues in
expectancy.
(f) A statement that revenue bonds of the district will be issued
to cover the cost of the works.
(g) A notice of the time and place when persons interested may
appear before the governing body and be heard as to any protests or
objections they may have against the acquisition or construction of
the proposed works and the issuance and sale of bonds.
The owner of property that may be benefited by the
acquisition, construction, extension, or operation of the works
referred to in this chapter may file with the district a request that
a particular work be undertaken. The request may, but need not,
include the descriptions and estimates referred to in Section 4966
and shall not be denied without a public hearing.
