. By the Federal-Aid Highway Amendments of 1974, and the
Federal-Aid Highway Act of 1976, Congress has enacted Section 219 of
Title 23 of the United States Code establishing a Safer Off-System
Roads Program for the construction, reconstruction, and improvement
(including, but not limited to, the correction of safety hazards, the
replacement of bridges and the elimination of high-hazard locations
and roadside obstacles) of any toll-free road, which is not on any
federal-aid system and which is under the jurisdiction of and
maintained by a public authority and open to public travel. Boards of
supervisors, city councils, the department, and the commission may
do all things necessary and proper in their respective jurisdictions
to secure the federal funds available under this program for local
roads and state highways in accordance with the intent of the federal
act and this chapter.
