The unit designated as Hogan Dam and Reservoir,
substantially in accordance with the recommendations of the Chief of
Engineers in House Document No. 545, 78th Congress, Second Session,
and authorized by act of Congress approved December 22, 1944, Public
Law 534, 78th Congress, Second Session, subject to such further
modifications thereof as the department may adopt, and such unit may
be constructed, maintained, and operated separate and apart from any
or all other units thereof.
Pending construction of the unit described in Section 11252,
herein designated "New Hogan," the department may acquire and
operate as a unit of the project, separate and apart from any or all
other units thereof, the existing Hogan Dam and Reservoir and
appurtenant works, herein designated "Old Hogan," located on the
Calaveras River and owned by the City of Stockton, and may integrate
the operation thereof with "New Hogan" when it is constructed.
Contracts entered into between the department and the City
of Stockton in connection with the transfer of "Old Hogan" to the
State, including provisions for the delivery of water from the dam
and reservoir, shall not be subject to the limitations contained in
Section 11139.
